Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 06.09.2017 passed in Cr. Misc. No. 38796/2017 with observation that the petitioner may renew his prayer for bail after framing of charge.
Submission of the learned counsel for the petitioner is that charge has been framed in this case on 19.02.2018 and petitioner is in custody for about 10 months and there is no specific allegation of assault against the petitioner. Heard learned A.P.P. as well as the informant who opposed the prayer for bail.
In view of the facts and circumstances of the case, the
Patna High Court Cr.Misc. No.14607 of 2018 (2) dt.14-03-2018 2/2 prayer for bail of the petitioner is allowed. Let the petitioner named above be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge-II, Saharsa in connection with S.Tr. No. 116 of 2017/159 of 2017, arising out of Bakhtiyarpur (Balwahat) P.S. Case No. 327 of 2016, subject to the condition that his bailors must be local having sufficient immovable properties within the jurisdiction of the court and that the petitioner will cooperate in investigation of the case and will appear before the Investigating Officer as and when required, failing which his bail bond shall be liable to be cancelled.
