1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Gaighat P.S. Case No. 243/2023 dated 23.06.2023 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 435, 436, 427, 504 and 506 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and came to be falsely implicated in the present case. It is next submitted that in sum and substance the allegation is that on account of road accident, two people died when the villagers started gathering at

No.3358 of 2024(2) dt.12-02-2024 2/2 the place of occurrence and after sometime more than 200 people gathered and started pelting stones on police for their inaction in not controlling the traffic leading to accident causing death. The learned counsel submits that from bare perusal of the allegation as alleged in the F.I.R., it would manifest that there is no specific allegation is alleged against the petitioners.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1-cum-Additional Munsif-II, Muzaffarpur in connection with Gaighat P.S. Case No.243/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
