The petitioner is apprehending his arrest in a case registered under Section 376 of the Indian Penal Code. The prosecution allegation, in short, is that while the complainant was returning to her house, the accused persons stopped her and took her to a place and tried to commit rape on her.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Due to land dispute, the present complaint case has been filed. There is no medical report to support the allegation

Patna High Court CR. MISC. No.81975 of 2019(2) dt.18-12-2019 2/2 made in the complainant case. Assuming the allegation made in the complaint case to be true, at best, it is a case for an offence under Section 354 IPC.

On behalf of the State, it is submitted that the petitioner is named in the complaint case.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Complaint Case No. C1/333/19, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
