2. The petitioner has prayed for bail in connection with Ghogha P.S. Case No. 113 of 2024 registered for the offence punishable under Sections 80(2), 90(2) and 3(5) of B.N.S.

3. The case of the prosecution, in short, is that the petitioner was married to Chandani Kumari (deceased). After three months, there was demand of Rs. 50,000/- by the petitioner and for that, she was being subjected to cruelty on account of nonfulfillment thereof. It is further alleged that she was being assaulted by the petitioner as the deceased was pregnant, she was assaulted to the extent that she died with the new born in the hospital.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

Learned counsel for the petitioner has submitted that he has annexed the entire treatment papers and from perusal of the CBC report of the deceased, it is clear that on 15.06.2024 her hemoglobin was 5.5. It has further been submitted that from perusal of the postmortem report also it is clear that the doctor conducting the autopsy has opined that death appears to be natural due to disease of lungs. No antemortem injury was found. Petitioner is languishing in judicial custody since 28.12.2024.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-XI, Bhagalpur in connection with Ghogha P.S. Case No. 113 of 2024.
