====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Laheriasarai P.S. Case No. 405 of 2017, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving the secret information about keeping the illicit liquor near Gayatri temple, Vivah Bhawan Lane, Laheriasarai, the informant and other Police officials reached there. On seeing the Police personnel, two persons succeeded to flee away. On search, 307 bottles, each containing 180 ML India made foreign liquor recovered concealing behind the Thela in front of house of Md. Mozaffar. On inquiry, Police came to know that petitioner used to run the

Learned counsel for the petitioner submits that, in fact, petitioner is accused in P.R. No. 40 of 2017 corresponding to G.O. Case No. 1485 of 2017 in which his tempo driver was involved in carrying of liquor, due to that reason, petitioner has falsely been implicated in this case mere on suspicion. The petitioner is in custody since 22.11.2017 on remand to the aforesaid case.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. District and Sessions Judge-IV-cumSpecial Judge (Excise), Darbhanga, in connection with Laheriasarai P.S. Case No. 405 of 2017 corresponding to G.O. No. 1592 of 2017.
