The petitioner is apprehending his arrest in a case registered under Sections 406, 420, 384, 120B/34 of the Indian Penal Code.

Allegation is that the petitioner ordered for 1400 bags of cement worth Rs.4,47,800/-, which was paid by the informant to co-accused, but they did not supply the cement. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is dispute of settlement of money between the parties. They were dealing in cement. Prior to institution of the present case, a

Patna High Court CR. MISC. No.83500 of 2019(2) dt.17-12-2019 2/2 case was instituted by the petitioner against the informant in which compromise was entered into between the parties. The present case has been instituted for an oblique reasons. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Raj Nagar P.S. case No.143 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
