ANJANA MISHRA ORAL ORDER 10-04-2018 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Sangrampur P.S. Case No.184 of 2017 (G.R. No.3370 of 2017) for allegedly having committed the offence under Sections 379 of 411 of the Indian Penal Code and Section 4/40 of the Bihar Minor Minerals Concession Rules, 1972. Learned counsel for the petitioner submits that the petitioner is the owner of the vehicle, which is alleged to have been used for the purposes of illegal mining of sand, for which there was a prohibitory order. It is further submitted that no valid document was produced by the Driver and the Driver had escaped and, therefore, the petitioner being the owner of the

Considering the entire facts and circumstances of the case and that the petitioner had no knowledge that the sand was being carrying in his vehicle, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Vijay Pandey, S.D.J.M., Munger, in connection with Sangrampur P.S. Case No.184 of 2017 (G.R. No.3370 of 2017), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
