This is a case registered under Section 392 of the Indian Penal Code.

It is submitted by the petitioner's counsel that the recovery of truck has been made from co-accused Dharmendra Kumar who has been allowed bail in the Cr. Misc. No. 39076 of 2017. Petitioner has falsely been implicated in the case and he is in jail custody since 22.12.2016. Though he is accused in four other cases which have been mentioned in para 3 of the bail application but in all four cases he is on bail.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees

Patna High Court Cr.Misc. No.20891 of 2018 (3) dt.21-05-2018 2/2 Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 2nd, Danapur in Naubatpur P.S. Case No. 345 of 2016 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
