The grievance of the petitioner in the instant case is discrimination in the matter of grant of 2nd and 3rd ACP. Learned counsel appearing on behalf of the petitioner submits that juniors to the petitioner have been granted such benefit but the petitioner has been discriminated. He further submitted that petitioner has retired on 31.1.2018. Considering the fact that the petitioner has now

Patna High Court CWJC No.25558 of 2019(2) dt.20-12-2019 2/2 superannuated, the writ petition is disposed of with direction to the respondents to examine the claim of the petitioner and if it is found that any junior to him has been granted benefit of 2nd and 3rd ACP, the respondents shall adopt corrective measure and grant benefit of the same from the date juniors to the petitioner have been granted such benefit. Necessary decision in this regard may be taken within a period of sixty days from the date of receipt/production of a copy of this order. With the aforesaid, the writ petition stands disposed of.
