The petitioner seeks bail in connection with Motipur P.S. Case No.407 of 2019 registered under Sections 341, 324, 504, 307 and 379/34 of the Indian Penal Code. The accusation is that the informant, on receiving the telephonic information from Rudal Rai (petitioner), in the late evening of 03.09.2019, about the illness of his daughter, he along with his son Jitendra Kumar and wife Sona Devi proceeded for the sasural house of his daughter boarding on motorcycle. On reaching there, the informant saw that Suresh Rai and Mohan Rai were engaged in causing assault to his daughter and son-in-law. On seeing the informant, his son and

No.82773 of 2019(2) dt.13-12-2019 2/2 wife, they also started to cause assault them through iron rod and farsa, due to which the informant sustained injury on his head and also sustained fracture injury on his both hands. The son of the informant was also assaulted by them. They also snatched the gold chain from the neck of the daughter of the informant.
Learned counsel appearing on behalf of the petitioner submits that the petitioner was not present at the time of the alleged occurrence and, on mere suspicion, he has falsely been implicated in this case. The petitioner has no criminal antecedent and is in custody since 24.09.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate (West) Muzaffarpur, in connection with Motipur P.S. Case No.407 of 2019.
