The petitioner is accused in connection with P.S. Case No. 400 of 2017, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The accusation is that on receiving secret information about unloading of illicit liquor to the truck in Mohalla Chakmohabat, P.S. Ahiyapur, District-Muzaffarpur in the house of Dilip Bhagat, the informant being the Sub-Inspector of Excise Department, Eastern region, Muzaffarpur proceeded for verification then Dilip Bhagat on seeing the raiding party fled away taking the advantage of darkness. Thereafter, the truck was search from which 71 cartons of 750 ML India made foreign
Patna High Court Cr.Misc. No.18084 of 2018(2) dt.29-03-2018 2/2 liquor total volume of 690 liters and 06 cartons of 180 ML recovered from Honda Amaze Motorcycle, which was said to be driven by this petitioner.
Learned counsel for the petitioner submits that, in fact, the petitioner was driver of the said truck and he had no knowledge about keeping the alleged India made foreign liquor, which was unloaded on the placed of occurrence. Further submission is that petitioner has no criminal antecedent and is in custody since 17.12.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Muzaffarpur in connection with Excise Case No. 453 of 2017.
