JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-03-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

The petitioners want to renew their prayer for prearrest bail which was earlier rejected by order dated 16.02.2017 passed in Cr. Misc. No. 1989 of 2017, on the ground that this is a case of pure accident, no offence under section 304/34 of the I.P.C is made out rather offence under section 304 A of the I.P.C. is made out.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner by submitting that the prosecution version is corroborated with the postmortem report.

In the facts and circumstances stated above,

Patna High Court Cr.Misc. No.17367 of 2018 (2) dt.28-03-2018 2/2 finding no good ground for reconsideration of prayer for pre-arrest bail, again prayer for pre-arrest bail of the petitioner stands rejected in connection with Sanjhauli P.S. Case No. 26 of 2016 pending in the court of Sub. Judge 1st - Cum- A.C.J.M, Bikramganj, District- Rohtas.
