This is a case registered under Sections 302, 201/ 34 of the Indian Penal Code.

It is submitted by the petitioner's counsel that FIR has been lodged by the brother of the deceased who has died during her treatment at Ara Sadar Hospital on 3.6.2017. He submits that death of the victim has occurred after 14 years of the marriage. He is also submitted that during investigation independent witnesses have stated that it was a case a of accident and while trying to save the deceased, the petitioner has also suffered injury. Charge sheet has also been filed under Sections 306 and 498 of the IPC. Petitioner is in jail custody since 29.11.2017.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Bhojpur, Ara in connection with Bihea P.S. Case No. 182 of 2017 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
