JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-12-2019 Heard learned counsel for the petitioner, learned Additional Public Prosecutor appearing on behalf of the State as well as learned counsel for the informant.

The petitioner is apprehending arrest in connection with Mahila P.S. Case No 29 of 2018 for offences under Sections 498A and 504/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

The petitioner is the husband of the informant's daughter, namely, Pinki Kumari and the marriage took place on 20.06.2019.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.82034 of 2019(2) dt.11-12-2019 2/2 petitioner is ready to keep his wife with full honour and dignity provided she is not treated with cruelty. Learned counsel further admits that the wife is ready to stay with the petitioner. In order to restore conjugal right between the parties, this Court is inclined to grant indulgence on the condition that the petitioner shall keep his wife with full honour and dignity. Considering the aforesaid aspect of the matter, this Court is inclined to grant bail to the petitioner. Let the petitioner, above-named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Vaishali at Hajipur in connection with Mahila P.S. Case No 29 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. One of the bailors should be wife of the petitioner. (Anil Kumar Upadhyay, J) BT/- U T
