2. The petitioner seeks bail in connection with Barh P.S. Case No. 470 of 2023 registered for the offence under Sections 364A/34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner and other accused persons is of kidnapping a five year old boy.

4. The name of the petitioner has come in this case during investigation and materials have come to connect him with the crime including the confessional statement of one Nitish Kumar.

5. The petitioner is in custody since 29.09.2023.

6. Considering the fact that the petitioner is involved in the kidnapping of a five year old boy, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. The Court below is directed to expedite the trial of the petitioner and conclude the same at the earliest.

9. If there is no sufficient progress in the trial due to the fault of the prosecution side then the petitioner may renew his prayer for grant of bail.
