In this case, the petitioner is apprehending his arrest in connection with Nanpur P.S. Case No. 50 of 2017 (G.R. No. 195 of 2017) registered for offences under sections 406, 409, 420 and 120(B) of the Indian Penal Code.

The petitioner was an employee of the Bank for two years and, during that period, Rs. 1,74,100/- was credited in his account though, later on, the same was debited from his account.

Learned counsel for the petitioner submits that whatever money is there has already been returned to the

Patna High Court Cr.Misc. No.18909 of 2018(2) dt.05-04-2018 2/2 Bank. It further appears that the petitioner has resigned from the service and now he is employed in the office of Comptroller and Auditor General of India.

Looking to the entire facts and circumstances of the case as also keeping in view that the amount, in question, has already been debited from the account of the petitioner, let the petitioner, namely, Satya Brat Sudhansu, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sitamarhi in connection with Nanpur P.S. Case No. 50 of 2017 (G.R. No. 195 of 2017), subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to the condition that the petitioner will cooperate in the investigation and will present himself as and when the police will call for interrogation.
