Mr. Surendra Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-05-2020 Heard Md. Harun Quareshi, learned counsel for the petitioners on Video Conference for grant of bail for the aforesaid two petitioners.

The petitioners seek bail in connection with Special (Excise) Case No. 522 of 2019, arising out of Saharsa Sadar P.S. Case No. 958 of 2019, dated 23.10.2019, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the FIR that 29.25 litres of liquor was found from in front of the shop and which recovery has been saddled upon the petitioners. Though the aforesaid two petitioners have earlier been made accused in two cases of

Patna High Court CR. MISC. No.84526 of 2019(4) dt.12-05-2020 2/2 similar nature each, according to the learned counsel for the petitioners, both are on bail in the aforesaid two respective cases lodged against them.

The petitioners are in custody since 24.10.2019. Considering the period of custody of the petitioners and the nature of recovery of liquor, they are directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Saharsa in connection with Special (Excise) Case No. 522 of 2019, arising out of Saharsa Sadar P.S. Case No. 958 of 2019.
