The petitioner has filed the instant application for grant of bail in a case registered for the offence under sections 272,273 IPC and 30(a) of the Excise Act.

As per allegation in the FIR, 45 litres of Nepali liquor is stated to have been recovered from motorcycle and the petitioner was arrested.

It is submitted by learned counsel for the petitioner that neither the motorcycle nor the seized illicit liquor belongs to the petitioner. He is in custody since 16.10.2019 and charge sheet has been submitted in the case. It is further stated that the petitioner has no criminal antecedent.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.82261 of 2019(2) dt.11-12-2019 2/2 taking into consideration the above stated fact, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-IInd-cum-Special Judge, Excise Act, Madhubani in connection with Kaluahi P.S. Case No.139 of 2019.
