Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner submits that petitioner was granted the privilege of provisional anticipatory bail by an order dated 8-1-2026, but in the order dated 8-1-2026 it was recorded that petitioner is a person with clean antecedent, when he has antecedent of two cases and the same fact was brought on record by way of supplementary affidavit filed on 16-12-2025, but then the same could not be brought to the notice of the court when the order dated 8-1-2026 was being passed. It is next submitted that petitioner was granted the privilege of provisional anticipatory bail with a condition that the learned trial court shall verify his criminal antecedents. 3.

In view of the submissions made by learned

No.90782 of 2025(3) dt.29-01-2026 2/3 counsel for the petitioner and after perusing the supplementary affidavit, para-3, 6 and 7 of order dated 8-1-2026 are modified to the extent to read as - "3. Learned counsel for the petitioner submits that the petitioner has antecedent of two cases and allegation is of recovery of 81 litres of liquor from a motorcycle.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from 8-1-2026, be released on Provisional anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Salmari P.S. Case No. 143 of 2025 (CIS Reg. No. 181 of 2025), subject to the conditions as laid down under Section 482(2) of the BNSS.

It is made clear that thereafter the learned Trial Court shall verify the criminal antecedent of the petitioner and in the event if it is found that petitioner has antecedent of more than two cases then it would be presumed that petitioner, for the purposes of seeking anticipatory bail, had concealed his

No.90782 of 2025(3) dt.29-01-2026 3/3 antecedent before this Court, as such, the provisional anticipatory bail order shall not be confirmed, but after verification if it is found that petitioner has antecedent of two cases in that event the provisional anticipatory bail order shall be confirmed forthwith."

The order dated 8-1-2026 has been modified for the reason that the supplementary affidavit was already on record, when the order dated 8-1-2026 was passed.
