2. Petitioners apprehend arrest in a case registered for the offence punishable under section s 341 , 323 , 325 , 307, 302 and 34 of the I. P . C .
3. As per the prosecution case, petitioner No. 1 is alleged to have assaulted the brother of the informant by means of iron rod on account of which the leg of the brother of informant got fractured and so far as petitioner No. 2 is concerned, he is only alleged to have brandished the country made pistol and no specific allegation is alleged against him.
4. Considering the nature of accusation of petitioner
Patna High Court CR. MISC. No.2749 of 2024(2) dt.31-01-2024 2/2 No. 1 , prayer for pre-arrest bail of the petitioner No. 1 , namely Dharendra Rai @ Dharmendra Rai is rejected.
5 . Considering the fact that no specific allegation of overt act is alleged against petitioner No. 2, namely Ravindra Rai, in the event of arrest or surrender within six weeks from today, let the petitioner No. 2 , as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J . M. 1st Class, Saran in connection with Mashrakh P.S. case No. 276 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
