Mr.Arun Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-01-2020 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners apprehend their arrest in connection with Complaint Case No. 989/ 2018 giving rise to Tr. No. 3428 of 2019 for the offence punishable under Section 498/34 of the Indian Penal Code.

The allegation is regarding the son of the petitioners having married the complainant in the year 2015 and it is further alleged by the complainant that the accused persons had tortured her for demand of dowry and thereafter they had also thrown the complaint out of the matrimonial home.

The learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.85384 of 2019(2) dt.07-01-2020 2/2 that the petitioners are innocent, they are the father-in-law and mother-in-law of the complainant and if any person has got any role in the alleged occurrence, it is their son and not the petitioners. It is further submitted that the petitioners are having a clean antecedent. Having regard to the facts and circumstances of the case and considering the fact that the petitioners are the father-in-law and mother-in-law of the complainant, I deem it fit and proper to direct for release of the petitioners on anticipatory bail. Accordingly, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners above named are directed to be released on anticipatory bail on furnishing bail- bonds of Rs.

10,000/- each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sadar Sitamarhi in connection with Complaint Case No. 989 of 2019 giving rise to Tr. No. 3428 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
