JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 3.5.2017 passed in Cr.Misc.No. 32142 of 2016 with direction to learned trial court to conclude the trial within a period of nine months.
Submission of learned counsel for the petitioner is that petitioner is in custody for more than two years and only five witnesses have been examined in this case and there are 36 charge sheeted witnesses.
Heard learned APP also.
Having heard both sides and in view of the facts and circumstances, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and at the same time Superintendent of Police, Jamui is
Patna High Court Cr.Misc. No.19283 of 2018 (2) dt.12-04-2018 2/2 directed to ensure the attendance of the witnesses in court so that the trial may be concluded at the earliest. The aforesaid direction must be complied with strictly.
Learned trial court is further directed to submit monthly report to this Court so that this Court may aware about the progress of the trial.
