JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 17.10.2017, seeks bail in Pakridayal PS Case No. 16 of 2017 registered under Sections 387 and 120B of the IPC.

The allegation in brief is that extortion demand of thirty lakh rupees was made from a particular mobile number mentioned in the FIR belonging to one Shiv Shankar Sharma.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, only material transpired against the petitioner is that he is also member of the gang as per confessional statement of one Mritunjay Thakur, one of the accused not named in the FIR who was earlier granted bail by a coordinate Bench of this Court in Cr. Misc. No. 34965 of 2017, and the petitioner seeks bail on the ground of parity.

Having considered the said facts and circumstances, the petitioner, namely, Guddu Sah is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 5th ACJM Motihari, East Champaran in connection with Pakridayal PS Case

Patna High Court Cr.Misc. No.19671 of 2018 (2) dt.05-04-2018 No. 16 of 2017 with the condition that the petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled..
