JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-03-2020 Appellant seeks bail in connection with Barachatti P.S.Case No. 508 of 2019 registered for the offences punishable under Sections 147, 148, 149, 323, 307, 379, 457, 504, 506 of the Indian Penal Code, Section 27 of the Arms Act and Section 3 (1)(r)(s) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Allegation against the appellant, including one named accused and five unknown accused is that they entered inside the house of the informant, abused her and assaulted her, causing injuries to her and it is also alleged that one Akhilesh Yadav hit the informant, causing injuries to her. Submission of learned counsel for the appellant is that the injuries are simple in nature and Akhilesh Yadav has already been granted bail by a co-ordinate Bench of this Court by
Patna High Court CR. APP (SJ) No.5527 of 2019(4) dt.18-03-2020 2/2 judgment dated 6.2.2020 passed in Cr.Appeal (SJ) No. 5617 of 2019 and he is in custody for more than four months. Heard learned Special P.P.
In view of above facts and circumstances, let appellant, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, SC/ST Act, Gaya, in connection with Barachatti P.S.Case No. 508 of 2019.
Accordingly, this appeal is allowed and the impugned order dated 26.11.2019 is set aside.
