Patna High Court CR. MISC. No.87068 of 2019(3) dt.23-06-2020 2/3 The petitioners seek bail in anticipation of their arrest in connection with Dighalbank P.S. Case No. 67 of 2019 dated 25.08.2019 instituted for the offences under Sections 302, 201/34 of the Indian Penal Code. It appears that petitioners have been suspected for killing the mother of the informant for her having practised necromancy. Informant is not an eye witness of the occurrence and the dead body which was recovered and identified to be that of the mother of the informant was almost decomposed.
Apart from this, the suspicion on the petitioners is because of old dispute which also arose out of the belief that family members of the informant including the deceased practised witchcraft.
During the pendency of this petition, petitioner no. 2 /Bablai Soren @ Babu Ram Soren was arrested. His application was dismissed as having become infructuous vide order dated 20.02.2020.
Considering the afore-stated facts, the petitioners, above named, except petitioner no. 2/, are directed to be

No.87068 of 2019(3) dt.23-06-2020 3/3 released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Kishanganj, in connection with Dighalbank P.S. Case No. 67 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
