1. Heard learned Counsel for the petitioner and learned APP for the State.
2. This application, for grant of anticipatory bail, arises out of Hathua P.S. Case No. 242 of 2024, disclosing offences punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act.
3. As per the First Information Report, on 07.10.2024, the informant, on a secret information that the petitioner and other co-accused person were transporting illicit liquor, proceeded towards the place of occurrence and intercepted a motorcycle. On seeing the police party, the accused persons fled away leaving behind their motorcycle loaded with cartons. On search, police recovered 86.400 liters of country made liquor from the said cartons.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is neither the owner of the seized motorcycle nor he has any concern with the seized liquor. The petitioner has got criminal antecedent of five cases.
5. Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is having criminal antecedent of five cases, I am not inclined to exercise my discretion for grant of anticipatory bail.
6. This application is, accordingly, dismissed. (Anil Kumar Sinha, J) Suruchi/- U T
