Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 23.3.2017 passed in Cr. Misc. No.10194 of 2017 on merit.
Submission of the learned counsel for the petitioner is that except confession there is nothing against the petitioner and a direction was also given to the learned court below to conclude the trial within a period of one year but up-till-now the trial has not been concluded.
Heard learned A.P.P. also.
Having heard both sides and from perusal of the report it appears that the case is still pending for appearance. Considering the aforesaid facts and curcumas, let the
Patna High Court Cr.Misc. No.23102 of 2018 (3) dt.09-05-2018 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class Gaya in connection with Sherghati P.S.Case no.129 of 2016, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
