JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks bail in connection with Special (NDPS) Case No.109 of 2019 arising out of F. No. NCB/PZU/V/18/2019 registered for the offence punishable under Sections 8/20/25/29 of NDPS Act.

As per F.I.R., huge quantity i.e. 570 kg of ganza was recovered from the truck. Petitioner was following the truck in a car. He is also the owner of the truck.

Submission of learned counsel for the petitioner is that admittedly nothing has been recovered from the conscious possession of the petitioner or from the car in which he was travelling. He is in custody for more than four months.

Patna High Court CR. MISC. No.83534 of 2019(2) dt.13-01-2020 2/2 Heard learned APP and learned counsel for the Union of India, who has opposed the prayer for bail considering the huge quantity of ganza has been recovered from the petitioner. Having heard both sides, I am not inclined to grant bail to the petitioner.
