2.The petitioner is not named in the F.I.R. and apprehending his arrest in connection with Desari P.S. Case No. 89 of 2018 registered for the offences punishable under Sections 304(B) r/w 34 of the Indian Penal Code.

3. Name of petitioner transpired in present case during the course of investigation where it appears that he participated in last rites of deceased daughter of the informant, who said to be killed by named co-accused persons due to non-fulfillment of demand of dowry.

It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner implicated in this case only being the nephew of the husband of the deceased and further for the reason that he participated in last rites of the deceased daughter of the informant. It is submitted that husband of deceased daughter of the informant was granted regular bail by one of the learned Co-ordinate Bench of this Court through Cr. Misc. No. 44553 of 2021 dated 23.03.2022, whereas in-laws were granted anticipatory bail by one of the learned Coordinate Bench of this Court through Cr. Misc. No. 70251 of 2024 dated 04.10.2024. It is submitted that petitioner is distantly related with husband of deceased and admittedly living separately from deceased and her husband, having otherwise no connection with daily and domestic affairs. While concluding argument, it is submitted that petitioner is a man of clean antecedent.

6. In view of aforesaid facts and circumstances

No.90374 of 2024(5) dt.08-05-2025 3/3 as petitioner is in-law i.e., nephew of the husband of the deceased, where maximum allegation surfaced against him is to participate in last rites of deceased daughter of the informant, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM IV, Vaishali Hajipur/concerned Court, where the case is pending in connection with Desari P.S. Case No. 89 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/ Section 482(2) of BNSS.
