The petitioner seeks regular bail in connection with Islampur P.S. Case No. 429 of 2019 for the offence punishable under Sections 25(1-b)a/ 26/ 35 of the Arms Act. The allegation is regarding recovery of one country made pistol and one cartridge as also one Khokha from the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 12.09.2019. Having regard to the facts and circumstances of the case and considering the submissions made by the learned

No.87320 of 2019(2) dt.16-01-2020 2/2 counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner immediately upon completion of six months of his custody i.e. w.e.f. 12.09.2019 and further subject to such condition as may be imposed by the learned court of Additional Sessions Judge-II, Hilsa (Nalanda) in connection with Islampur P.S. Case No. 429 of 2019.

The petition stands disposed of with the aforesaid observations and directions.
