The petitioner, already in custody, seeks bail in connection with SGR Case No. 31 of 2017 arising out of Chanpatia (Sirisiya OP) P.S.Case No. 206 of 2017 registered under Sections 323,376,504 and 506 of the Indian penal Code and Section 4 and 6 of the Protection of Children from Sexual Ofences Act.
Allegation in brief is that victim/informant's elder sister's marriage was solemnised with one of the agnates of the petitioner and she had gone to her relative's house along with her father to participate in marriage ceremony. After ten months, prior to lodging to the case, petitioner continuously committed rape and promised to marry her and she became pregnant for seven months. Thereafter she disclosed the matter to family members.
Patna High Court Cr.Misc. No.20813 of 2018(4) dt.25-06-2018 2/2 Submission is that allegation is false and there is no evidence on record regarding pregnancy or of committing rape with the informant, she is major and to put pressure upon the petitioner to marry, this case has been lodged. Having considered the aforesaid facts and circumstances, the petitioner, namely, Rupak Sah, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-1st-cum-Special Judge, Bettiah, West Champaran in connection with S.G.R.Case No. 31 of 2017 arising out of Chanpatia (Sirisiya OP) P.S. Case No. 206 of 2017.
