This is an application for grant of anticipatory bail in connection with Baikunthpur P.S. Case No. 165 of 2019 registered for the offence punishable under Sections 341, 307, 120(B)/ 34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding unknown miscreants having fired on the informant and the gunshot hit the wiser of the motorcycle of the informant. It is further alleged that since the informant has old land dispute with the petitioner and his family members, he suspects that the petitioner and his family members in collusion with other co-accused persons had set up some persons who fired on him.

The learned counsel for the petitioner submits that the

It is further submitted that admittedly, there is no allegation of any specific overt act as far as the petitioner is concerned. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur P.S. Case No. 165 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) ajay gupta/- U T
