2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.
3. As per FIR, when the informant returned to her village on 13.11.2022 at about 11:00 hours in the night, she found that doors of all the rooms were broken and silver, gold ornaments and other articles of Rs. 6,00,000/- was missing.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that no incriminating article has been recovered from the conscious physical possession or from the house of the petitioner. He submits that the petitioner has been made accused in this case on the basis of confessional
Patna High Court CR. MISC. No.2392 of 2024(2) dt.08-02-2024 2/2 statement of co-accused. He submits that the petitioner has five criminal antecedents of similar nature as mentioned in para-3 of this application.
5. However, learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Tajpur P.S. Case No. 550 of 2022.
