The petitioner apprehends his arrest in Balua Bazar(Lalitgram O.P.) P.S. Case No.3 of 2018 registered under Section 307 and other minor Sections of the Indian Penal Code. The informant alleged that the dispute arose only because the petitioner and others were trying to install boring set on the borewell of the informant and thereafter the petitioner and other accused persons assaulted the informant and others. The learned counsel for the petitioner submits that there is a case and counter case. No specific allegation of assault is made against the petitioner. The petitioner and other accused persons are alleged to have assaulted Manoj Yadav, Shyam Sunder Yadav, Rajendra Yadav and Sheonarayan Yadav. They all
Patna High Court Cr.Misc. No.22023 of 2018 (3) dt.17-05-2018 received simple injuries. From the side of the petitioner also, many others were injured. Other accused persons have already been granted anticipatory bail but anticipatory bail of the petitioner was refused only because the petitioner is alleged to have assaulted Sheonarayan Yadav with farsa but no injury was found on the person of the informant.
Taking into consideration the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Balua Bazar(Lalitgram O.P.) P.S. Case No.3 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
