Petitioners are apprehending arrest in connection with Motipur P.S. Case No. 303 of 2019 for the offence under sections 341, 307, 323, 379, 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioners have no criminal antecedent.
Referring to prosecution case, learned counsel submits that specific allegation is against Rampravesh Rai and not against these petitioners.
Considering the fact that there is no overt act against these petitioners, the Court is inclined to grant bail, let the
Patna High Court CR. MISC. No.82057 of 2019(2) dt.11-12-2019 2/2 petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West Muzaffarpur, in connection with Motipur P.S. Case No. 303 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.
