The petitioner seeks bail in connection with Bairgania P.S. Case no. 34 of 2018 registered under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act-2016.

9 lts. of Nepali Saufi wine is said to have been recovered from the possession of the petitioner and petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. She has no concern with the seized liquor. She has been falsely implicated in the case at

Patna High Court Cr.Misc. No.21390 of 2018(2) dt.16-04-2018 2/2 the instance of her enemy by planting the aforesaid recovery from her possession. She has no criminal antecedent. She happens to be lady. She has been languishing in custody since 02.03.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise, Sitamarhi in connection with Bairgania P.S. Case no. 34 of 2018. (Prakash Chandra Jaiswal, J) rohit/- U T
