The petitioner seeks regular bail in connection with Sangrampur P.S. Case No. 121 of 2015 registered for the offence under Sections 304B, 201/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner happens to be husband of the deceased and neither he assaulted the deceased and nor he demanded any dowry. He has falsely been implicated in this case. The petitioner is languishing in judicial custody since 14.05.2019.
Learned A.P.P. for the State has opposed the prayer for
Patna High Court CR. MISC. No.82259 of 2019(4) dt.04-06-2020 2/2 bail and submitted that there is direct allegation against the petitioner that he demanded motorcycle as a dowry and threatened to kill his wife if the demand will not be fulfilled. Accordingly, the petitioner has assaulted his wife on nonfulfillment of dowry demand resultantly she died. Considering the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for grant of regular bail is rejected. However, the trial court is directed to expedite the trial.
