The petitioner is in custody since 17.11.2019 in connection with Excise Case No. 497 of 2019 for the offence registered under Section 30 (a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that though the alleged recoveries have been attributed to the present petitioner, the petitioner has no concern either with the alleged recoveries or the truck from which it was seized. It is further submitted that nothing has been recovered from the conscious possession of the petitioner and he has no criminal antecedent. Considering the aforesaid facts and circumstances of
