This is the second attempt of the petitioner for grant of anticipatory bail in connection with Sursand P.S. Case No.303/2021 dated 29.06.2021, registered for the offence punishable u/s 302/34 of the IPC, pending in the Court of learned S.D.J.M.(P), Sitamarhi.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the

Patna High Court CR. MISC. No.3280 of 2024(2) dt.19-01-2024 2/2 learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that one of the co-accused has been granted anticipatory bail by a co-ordinate Bench of this Court.
