The petitioner has been in custody since 15.08.2019 in connection with K. Nagar P.S. Case No. 311 of 2019 registered for the offence punishable under Sections 399/402 of the Indian Penal Code and Section 25(1-b)a,26,35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has been taken into custody only on suspicion and when the police raided the place where the accused persons had assembled under a newly constructed medical college, some neighbours wanted to know the reason as to why they had assembled and only on suspicion they were taken into custody that they were planning to commit some offence. No.84449 of 2019(2) dt.19-12-2019 2/2 submitted that no incriminating article has been recovered from the possession of the petitioner and the mobile phone which is alleged to have been recovered belongs to the petitioner himself. Considering the aforementioned facts and circumstances of the case and that the petitioner has no criminal antecedents, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with K. Nagar P.S. Case No. 311 of 2019.
