The petitioners have filed the instant application for grant of anticipatory bail apprehending their arrest in connection with Athmalgola P.S. Case no. 108 of 2019 registered for the offence under sections 143, 147, 447, 448, 323, 307 and 379 of the Indian Penal Code.

No.953 of 2020(3) dt.25-02-2020 2/3 As per the allegation in the FIR, the accused persons including the petitioners herein as also one Laleshwar Paswan are said to have assaulted the informant and the members of his family as a result of which they sustained injuries. It is submitted by learned counsel for the petitioners that there is case and counter case between the parties, the correct version have been narrated in the FIR lodged by the wife of the petitioner no. 1 being Athmalgola P.S. Case no. 111 of 2019. It is submitted that the petitioners have no criminal antecedent. The aforesaid Laleshwar Paswan and two others have been enlarged on bail by order dated 18.12.2019 passed in Cr. Misc. no. 70631 of 2019.
The application for bail has been opposed by learned APP for the State.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, the Court is inclined to enlarge the petitioners on bail. The petitioners above named, in the event of their arrest or surrender in the Court below within a period of six weeks from today in connection with Athmalgola P.S. Case no. 108 of 2019 are directed to be enlarged on bail on each of them furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like
