JUSTICE MADHURESH PRASAD ORAL ORDER 18-08-2022 The counsel for the petitioner after some arguments has realized that the order of punishment dated 25.01.2019, hardly a month before the petitioner's retirement, has not had any consequence on his admissible pay or the pension admissible to the petitioner.

He, however, submits that gratuity and leave encashment have not been paid to the petitioner. For that, however, there is no prayer in the writ application. This Court, therefore, is not inclined to enlarge the scope of the writ petition.

Patna High Court CWJC No.806 of 2020(6) dt.18-08-2022 2/2 However, before parting with the order, this Court would observe that the petitioner may approach the respondent no.3 for grant of these benefits and, needless to say that the respondent no.3 would be obliged to pass a reasoned and speaking order giving the details of the amounts due and admissible to the petitioner.
