====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-05-2025

1. Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 354(B), 504 and 506 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that Md. Najir did not agree with the Panchayati, thereafter Mosim assaulted the informant by farsa causing injury on head, thereafter Mosim also assaulted his father by sword causing injury on head who fell down and became unconscious

Patna High Court CR. MISC. No.13847 of 2025(3) dt.12-05-2025 2/3 thereafter Mokim assaulted his sister by sword causing injury on wrist while Dilshad took Rs.5,000/- and rest of the accused also assaulted.

4. Learned counsel for the petitioners submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of assault is against Mosim and Mokim and against rest of the accused, the allegation of assault is general and omnibus in nature. It is reiterated and submitted that petitioners are persons with clean antecedent and are not criminal but then they came to be implicated merely because they are related with Mosim and Mokim.

5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioners but then are not in a position to rebut the submissions of the learned counsel appearing on behalf of the petitioners that there is no specific allegation against the petitioners rather the allegation is general and omnibus in nature and as far as allegation against Dilshad is concerned the same is ornamental in nature.

6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in
