JUSTICE BIRENDRA KUMAR ORAL ORDER 18-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 7 of the Essential Commodities Act.

The petitioner is in custody since 26.02.2018. Allegation is that some government grains (rice and wheat) in different bags were recovered from the premises of the petitioner which was meant for subsidized supply to the beneficiaries. Submission of the learned counsel for the petitioner is that the FIR is based on mere suspicion. The petitioner is not a PDS dealer. The empty bags of Food Corporation of India are already available for purchase in the

Patna High Court Cr.Misc. No.24346 of 2018 (5) dt.18-06-2018 P2/ market. The petitioner has got not criminal antecedent. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khiri More P.S. Case No.21 of 2018, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
