====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-01-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 147, 149, 324, 325, 307, 504, 506 of the Indian Penal Code.

3. As per F.I.R., all the accused persons including this petitioner armed with knife, iron rod, lathi came and started assaulting the informant by tying gamcha around her neck. When son of the informant came to save her, this petitioner along with co-accused Lalmuni Sahni inflicted knife blow on his head due to which he became unconscious and fell down and when her daughter came to the rescue, she was also assaulted.

4. Learned counsel for the petitioner submits that due to petty dispute, an altercation took place between the parties in which both sides sustained injuries. Case and counter case. Case

Patna High Court CR. MISC. No.89656 of 2024(2) dt.29-01-2025 2/2 lodged by the mother of petitioner vide Aurai P. S. Case No. 102 of 2024 is earlier in point of time. Injuries sustained by the injured are simple in nature. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, nature of accusation, simple injury and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, East Muzaffarpur in connection with Aurai P. S. Case No. 103 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
