The petitioner has filed the instant application for grant of bail in a case registered for the offence under section 379 of the Indian Penal Code.

As per the allegation in the FIR, truck of the informant was stolen and FIR was registered against unknown. It is submitted by learned counsel for the petitioner that for the same occurrence two FIRs one being Sahajitpur P.S. Case no. 50 of 2019 was registered under section 414 of the Indian Penal Code while the instant Lauriya P.S. Case no. 90 of 2019 was registered under section 379 of the Indian Penal Code. It is categorically stated that both FIRs related to the theft of the same truck, the details of which has been given in the FIR. It is

Patna High Court CR. MISC. No.81758 of 2019(2) dt.11-12-2019 2/2 further submitted that in FIR being Sahajitpur P.S. Case no. 50 of 2019, the petitioner has been enlarged on bail by order dated 05.09.2019 passed in Cr. Misc. No. 55153 of 2019. He is in custody since 20.09.2019 and besides the instant case he is accused only in the aforementioned Sahajitpur P.S. Case no. 50 of 2019.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the fact of the petitioner being enlarged on bail in the connected Sahajitpur P.S. Case No. 50 of 2019, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Lauriya P.S. Case no. 90 of 2019.
