2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 111, 317(3), 317(5), 61(2) of the BNS and Section 25(1-b)a, 26, 35 of the Arms Act.
3. As per prosecution case, informant namely Jitendra Kumar, alleged that on 20.11.2024, during the course of patrolling, informant and officials suspected one vehicle in which seven persons were sitting in suspicious condition and then they later disclosed that they are involved in cutting electric wire from pole and on search various items were recovered like wire cutter, aluminium wire, plastic slippers and

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is alleged to be the driver of the Bolero pick up van from which which stolen electric wire was recovered. Petitioner has been made accused on the basis of confessional statement of coaccused Mukesh Singh. No incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the nature of accusation, fact that no incriminating article has been recovered from conscious possession of this petitioner and clean antecedent, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Paharpur P.S.
