JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with East Champaran Town P.S. Case No. 10 of 2018, dated 10.01.2018, instituted for the offences punishable under Sections 307, 506, 509 with the aid of Section 34 of the Indian Penal Code and Section 27 of the Arms Act.
The son of the informant was fired at by four accused persons including the petitioner. The reason
Patna High Court Cr.Misc. No.24869 of 2018 (3) dt.28-06-2018 2/3 assigned in the First Information Report is an old dispute between the son of the informant and the four named accused persons including the petitioner. No body has been injured in the occurrence.
Learned counsel for the petitioner submits that an absolutely false case has been instituted which becomes very evident from the narration made in the First Information Report. There was no obstruction and in that event, if the firing would have been resorted by four persons, it was bound to hurt somebody.
Be that as it may, the petitioner has not been specifically alleged to have opened fire on the son of the informant. The petitioner was earlier made accused in two cases of the same nature, but his implication in the aforesaid cases was because of the dispute with the agnates of the village. In the aforesaid two cases, the petitioner is on bail.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.24869 of 2018 (3) dt.28-06-2018 3/3 satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with East Champaran Town P.S. Case No. 10 of 2018.
