The petitioner apprehends his arrest in Complaint Case No. 1941 of 2016 for the offences punishable under Section 420 of the Indian Penal Code.
The complainant alleged that the petitioner persuaded him to give Rs. 2 lacs 50 thousand for purchasing one katha of land but the petitioner did not execute the sale deed nor returned the money.
The learned counsel for the petitioner submits that the petitioner never received any money from the complainant.
Patna High Court Cr.Misc. No.26008 of 2018 (2) dt.04-05-2018 2/2 The petitioner has lodged Muffasil P.S. Case No. 200 of 2015 under Section 302 and other Sections of Indian Penal Code and under Section 27 of Arms Act against Sudhir Kumar Thakur and others. Sudhir Kumar Thakur happens to be close relative of the complainant and that is why the complainant has lodged this case. The complaint has not filed any chit of paper showing receipt of money.
Considering the fact that petitioner denied to have received any money, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Begusarai in connection with Complaint Case No.1941 of 2016 subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
