The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 379, 354, 447, 504, 506 of the Indian Penal Code, Allegation is that the accused persons abused and assaulted the informant by leg, as a result of which blood started coming out from the body of the informant and they also snatched golden mangal sutra and golden ear top of the informant. When informant's parents came to rescue her, they were also assaulted
Patna High Court CR. MISC. No.81968 of 2019(2) dt.18-12-2019 2/2 by the accused persons.
It has been submitted on behalf of the petitioners that the petitioners No.2, 3 and 4 have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Both the parties are agnates. Due to petty reason, the dispute took place in the house. From perusal of injury report, it appears that no grievous injury caused to the victim. Offences are triable by the Magistrate.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Majhaulia P.S. case No.297 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
